Hard Disk Drive Suspension Assembly Price-Fixing Investigation
Girard Sharp is investigating claims of a global conspiracy among manufacturers to fix prices of and allocate market shares for a key hard disk drive (HDD) component.
The U.S. Department of Justice (DOJ) recently announced that NHK, a Japanese manufacturer, agreed to plead guilty and pay a $28.5 million fine for its role in fixing prices of HDD suspension assemblies sold in the United States and elsewhere.
If you purchased a hard disk drive in the United States between May 2008 through April 2016, you may have a claim for relief. Protect your rights by speaking with a Girard Sharp antitrust attorney—dial 415-981-4800—or by submitting your information below:

Overview of Price-Fixing Allegations
A class action complaint recently filed in Michigan claims that NHK, TDK, and other manufacturers participated in a conspiracy to suppress and eliminate competition for HDD suspension assemblies by agreeing to rig bids for, and to fix, stabilize, and maintain the prices of, HDD suspension assemblies sold in the United States and elsewhere. The suit alleges that their anticompetitive activity enabled the cartel members to shore up their 90% dominance of the global market.
According to the complaint, from approximately May 2008 through at least April 2016, the defendant manufacturers and their co-conspirators contracted, combined, or conspired to fix, raise, maintain, and/or stabilize prices of and allocate market shares for HDD suspension assemblies in the United States.
Previously, in February 2018, the Japanese Fair Trade Commission (JFTC) issued a cease-and-desist order to TDK and NHK, finding that they substantially restrained competition in the HDD suspension assemblies market by agreeing to maintain prices. Both the DOJ and Brazilian antitrust authorities also launched investigations into price fixing of HDD suspension assemblies.
On July 29, 2019, the DOJ announced that NHK agreed to plead guilty and pay a $28.5 million fine for its role in an anticompetitive conspiracy.
