Recent complaints allege that the NFL, its pro football teams, and licensed NFL retailer Fanatics Inc. have engaged in anticompetitive tactics to unlawfully monopolize the online retail market for NFL Licensed Products. As a result of the alleged scheme, consumers have paid higher prices for these products, which are also becoming harder to find and declining in quality.

The NFL, its teams, and Fanatics reportedly conspired to boycott competing retailers that sold NFL Licensed Products through third-party online marketplaces, such as Amazon Marketplace. By boycotting competitors that would have charged lower prices, the alleged scheme increased and maintained the price of NFL Licensed Products.

Additionally, Fanatics Inc. (the dominant online retailer of NFL products) imposed an exclusive dealing arrangement on its suppliers, prohibiting them from selling NFL Licensed Products to Fanatics’ competitors and furthering monopolizing the market.

This scheme has allegedly created and maintained a retail monopoly that allows the NFL, professional football teams, and Fanatics to charge supercompetitive prices and share monopoly profits.
