Various health insurers have reportedly been using misleading marketing practices to attract new short-term policyholders. During the COVID-19 pandemic, consumers have enrolled in short-term insurance policies to bridge temporary coverage gaps. These short-term or “noncompliant” policies are not bound by the coverage rules of the Affordable Care Act.

The terms of these policies may permit the insurer to impose coverage limits inconsistent with how the policy is marketed, to deny coverage for common treatments or for consumers with preexisting conditions, or to keep an unreasonably high percentage of premiums collected. Some consumers also report having seen false or misleading statements regarding COVID-19 treatment and testing in connection with short-term policies.
