More Information on Tesla’s Potential Privacy Violations

The electric vehicle company Tesla includes driver monitoring systems in its newer motor vehicles, including in its Model 3 and Model Y vehicles. As part of these monitoring systems, some Tesla models can now record and transmit video footage of people in the car. 

Tesla recently stated that it studies footage obtained from these cameras in an effort to improve its self-driving technology. But in doing so, Tesla may be invading the privacy of drivers and departing from the monitoring system’s stated function—to alert drivers when they are not paying attention to the road.

The Illinois Biometric Information Privacy Act, 740 ILCS 14/1, et seq., was enacted to protect individuals from the collection, storage, and use of their biometric data without their informed consent, and to ensure that people can maintain control of their personal biometric information. The Act imposes stringent biometric consent provisions and provides for actual and liquidated damages for violations of the Act’s requirements.
